Cruise and Kidman Battle for Custody

He's got a new movie coming out with his new love. "Vanilla Sky" is expected to be a blockbuster in December. And she's got a hit right now with "The Others." It's raked in more than 80 million dollars. In public, Tom Cruise and Nicole Kidman seem to be rebounding nicely from divorce. But Celebrity Justice has learned the former couple is now locked in a custody fight.

Their attorneys even filed papers today related to a trial date just in case Kidman and Cruise can't settle this battle on the home front. Nicole wants to take their two children from Los Angeles to a saner life in Sydney, Australia. But according to our sources, Cruise says the move could cut him off from 8-year-old Isabella and six-year-old Connor.
The proceedings are private, but CJ got the inside story. Apparently, Tom and Nicole are willing to accept joint custody. The kids would spend six months out of the year with each parent, alternating every three months. But here's the sticking point: Tom says when Nicole has the kids in Australia, he'll be pushed out the picture completely.
It's a 14-hour flight from Tom's home base in L.A. to Sydney and even though he owns a private jet, he can't fly halfway around the world every time he wants to spend an afternoon in the park with his kids.
Divorce attorney Tracy Jensen says a judge would block Nicole’s move if it would be traumatic for their children. But, she says, “A move of the children to Sydney would not be a significant change for these children, given the lifestyles of their parents.
Tom and Nicole took Connor to Australia when he was just a baby. Now it's familiar territory for both kids. Shelly Ann Couch covers Hollywood for Australian TV. She believes Sydney is a better place to raise the children because the culture isn't centered on celebrities. But she says unfortunately, the kids still will be caught in the middle, wherever Kidman decides to live.
She says, “That's just one of the downfalls when you marry someone from another country, and he's an A-list famous movie star.”
